Agreement to Terms

By using eOnlineSchedule, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Eligibility

You must be at least 18 years of age to use this Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

Account Registration

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You may not use another person's account without permission

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Transmit any harmful or malicious code
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal or unauthorized purpose

Service Availability

We strive to provide continuous service availability, but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

Subscription Plans

Some features of the Service may require payment. By purchasing a subscription, you agree to pay all applicable fees as described at the time of purchase.

• All fees are in U.S. Dollars unless otherwise stated
• Subscription fees are charged on a recurring basis
• You authorize us to charge your payment method for all fees
• Fees are non-refundable except as required by law

Billing and Renewal

• Subscriptions automatically renew unless cancelled before the renewal date
• We will charge your payment method on the renewal date
• You can cancel your subscription at any time from your account settings
• Cancellations take effect at the end of the current billing period

Our Intellectual Property

The Service and its original content, features, and functionality are owned by eOnlineSchedule and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business purposes in accordance with these Terms. This license does not include:

• Any resale or commercial use of the Service or its contents
• Any derivative use of the Service or its contents
• Any downloading or copying of information for the benefit of another party
• Any use of data mining, robots, or similar data gathering tools

Your Content

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing the Service.

Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to the User Content
• Your User Content does not violate any third-party rights
• Your User Content does not contain harmful or illegal material
• Your User Content complies with these Terms and applicable laws

Maximum Liability

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the liability, or $100, whichever is greater.

Termination by You

You may terminate your account at any time by contacting us or using the account closure feature in your account settings. Upon termination, your right to use the Service will immediately cease.

Effect of Termination

Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability. All licenses granted by us shall immediately terminate.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which eOnlineSchedule operates, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be resolved through good faith negotiations. If the dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Modifications

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and eOnlineSchedule
• Severability: If any provision is found to be unenforceable, the remaining provisions will remain in effect
• Waiver: No waiver of any term shall be deemed a further or continuing waiver
• Assignment: You may not assign these Terms without our prior written consent
